DECLARATION
For entrants 18 years and over: By completing the entry form, I certify I have read and accept the terms and conditions for participation in this event.

I have read, understand and agree to the attached agreement.  
I agree to undertake all my obligations outlined in the terms and conditions. 

 

 

Entrants acknowledge that this event is being held without charge or fee by One Moore Rep and participation is completely voluntary. 

 

One Moore Rep reserves the right to use any material including and not limited to; photography, video, audio, written that is posted in the Zoom Conference, Google Document Sheet or any other One Moore Rep social media platform for any promotional material, other marketing content, editorial material produced or published without compensation. 

 

Entrants consent to royalty-free use of their name, result, image, photographs, video and comments in any publications and marketing in relation to this event by One Moore Rep.

I understand that my entrant details are collected by One Moore Rep for the purpose of conducting the Virtual Running Festival and associated events, including but not limited to identifying participants in the Virtual Running Festival, recording results, communicating with me and other participants about the Virtual Running Festival and other associated events and to assist One Moore Rep in improving and marketing its goods and services. I understand that by supplying One Moore Rep with my e-mail address I agree to receive regular e-newsletter updates from One Moore Rep in order to stay informed about One Moore Rep Services and Products. 

Upon providing your entrant details for the Virtual Running Festival you may be provided with further options to continue with a range of One Moore Rep services.

 

Entrants acknowledge that this is a Virtual Running Festival and that the organisers will not track or verify results or provide volunteers, marshalls or medical personnel assistance to any entrant. 

Entrants acknowledge they will participate and complete their nominated kilometres in a manner chosen by them, at locations chosen by them and at their own risk.

Entrants take part in Virtual Running Festival events entirely at their own risk and are 100% responsible for selecting a safe route to run. Entrants should wear hi-viz clothing when running in low light conditions and take care around traffic or when running off road.  One Moore Rep accepts no responsibility for any accidents or injuries sustained whilst taking part in a Virtual Running Festival.

 

 

Once the running festival has expired your access to the Virtual Running Festival Zoom Conference and any associated media and digital platforms will be removed. All data, information and images collected will no longer be accessible by you. It is your responsibility to retain any data, information or images that you have posted prior to the completion of the Virtual Running Festival. One Moore Rep is not responsible for the any loss of any data, information or images that you have logged during the course of the program. *

 

 

 

 

One Moore Rep retains the ability to terminate your access as indicated above for any reason as a result of your failure to follow direction or conduct contrary to the interests of this Agreement. One Moore Rep reserves the rights to terminate your access to the Virtual Running Festival  without any warning and notification. 

 

 

I recognise that the Virtual Running Festival may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities. I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in this exercise program. If I do suffer from any injury, condition or disability I will advise One Moore Rep immediately upon it becoming known to me. 

I acknowledge that my participation in the Virtual Running Festival is purely voluntary and in no way mandated by One Moore Rep. I am not obligated to perform nor participate in any activity that I do not wish to do, and that it is my right to refuse such participation at any time. I understand that should I feel light-headed, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity. 

I am aware that there are significant risks involved in all aspects of athletic activities and physical training. The activities, in which I will participate, are inherently dangerous and my cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. The significant risks include, but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains. I am aware that any of these above mentioned risks may result in serious injury or death to myself, my training partner, or other people around me. In behalf of my heirs, assigns, administrators, executors and next of kin, I waive all claims of damage, injuries and death sustained to me or my property, that I may have against One Moore Rep to such activities, including claims in tort, contract equity or otherwise. 

In consideration of my participation in Virtual Running Festival, I hereby waive and release One Moore Rep and its principals, agents, employees, officers, directors, affiliates, successors and assigns, coaches, trainers, and volunteers from any claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages, and liabilities, of every kid of nature, whether known or unknown in law or equity, that I ever had or may have arising from or in any way related to my voluntary participation and subscription to the One Moore Rep fitness program. 

I fully understand that I may injure myself as a result of my participation in the Virtual Running Festival and I hereby release One Moore Rep and its agents from any liability now or in the future for conditions or injuries that I may obtain. These conditions and injuries may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, trauma, anxiety, fears, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness that I may incur, including death. 

 

 

 

I, accept financial responsibility for any injury that I may cause either to myself or to any other participant due to my negligence. 

I further agree to indemnify and hold harmless One Moore Rep, their principals, agents, employees, trainers, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by One Moore Rep. 

 

One Moore Rep shall not be liable for any of the following: technical, hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer/internet transmissions or other errors or malfunctions of any kind which may prevent receipt by One Moore Rep of the registration or photo submission form or any other material related to the participation in the Virtual Running Festival. 

This participation agreement, waiver and release contains the entire agreement between the parties, and supersedes any prior written or oral agreements with One Moore Rep concerning the subject matter of this agreement, waiver and release. The provisions of this agreement, waiver and release maybe waived, altered, amended or repleaded, in whole or in part, only upon the prior written consent of all parties. 

The provision of the waiver and release will continue in full force and effect even after termination of the Virtual Running Festival for the benefit of One Moore Rep, whether by agreement, by operation of law, or otherwise. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect. *

 

By obtaining access to the Virtual Running Festival, you agreed to conduct yourself in positive, inclusive manner and in the spirt of good sportsmanship.  Any negative, unsportsmanlike, derogatory, discriminatory, abusive behaviour will not be tolerated and may result in your removal from Virtual Running Festival.

 

 

By agreeing to participate in the Virtual Running Festival you will obtain access to the Virtual Zoom Conference and Google Document sheet for the duration of the event.   You are not obligated or mandated to actively participate in the Zoom conference or log information in the Google Document.   However, by not participating in the Zoom conference or logging information in the Google Document it will make you illegible to obtain any prizes that maybe on offer. 

By agreeing to participate in the Virtual Running Festival, you agree not to mislead One Moore Rep officials, obtain an advantage by deception, or otherwise act dishonestly. 

 

One Moore Rep has sole rights in the issuing of any prizes or gifts associated with the participation in the Virtual Running Festival and reserves all right in this respect. 

If any provision in the terms and conditions, whether in full or in part, is held to be invalid or unenforceable, all other remaining provisions (in full or in part) shall continue to be valid and enforceable.
